ELIGIBILITY: The CEA Study Abroad Photography Contest (Contest) is open to all participants on a CEA 2008 summer study abroad program. Officers, directors, employees, and members of their household and of their immediate families (i.e., parents, children, stepchildren, spouse, siblings, and persons residing in the same household of such immediate family members), of CEA, its subsidiaries, affiliates, suppliers, wholesalers, distributors, sales representatives, advertising/promotion agencies, and/or their affiliates, assigns or representatives; (herein after referred to collectively as "Sponsor & Others"), and all other persons or entities associated with the development, administration, promotion, or execution of the Contest are ineligible by law to enter. Submission of an entry into the Contest (herein after refereed to as "Contestant") constitutes permission to use the Contestant's name, and/or likeness for advertising/trade without further consent or compensation, unless prohibited by law. All submitted materials become the property of CEA and remove Contestant from any royalties or reimbursements of said photo submission. Participation in the Contest constitutes Contestant's full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor and judging as done by vote through the CEA blog, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.
HOW TO ENTER: CEA is looking for your creative insight into some aspect of your study abroad experience. To enter the Contest, Contestants must be (1) onsite and participating in a CEA program, (2) submit a photo taken onsite in the Contestant's study abroad city, campus, or on a CEA sponsored excursion that is of high resolution digital quality (minimum 1600x1200 pixels, preferably 3 megapixels or larger) in .jpg format to an album on BubbleShare according to the How to Enter in 4 Simple Steps directions and these official rules, betweenJuly 21, 2008 and 11:59 p.m. MST on August 10, 2008. (3) Submit the Contest Entry Form to the Contestant's applicable Onsite Director between the above dates. All entries must be submitted in the name of a living individual person and prizes can only be awarded to the CEA program participant whose name is on or corresponds to each winning entry.
CEA is not responsible for misdirected, unintelligible, incomplete, lost, late, illegible, undelivered, stolen, or postage due entries, technical, hardware or software failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmissions or other errors or problems of any kind which may limit or affect a person's ability to participate in the Contest. In the event of sabotage, acts of God, terrorism, computer virus, mechanical, technical, or operational defect or error or other events or causes beyond the Sponsors' reasonable control, which corrupt the integrity, administration, security or proper operation of the Contest, CEA reserves the right to cancel, modify or suspend the Contest. In the event of cancellation, prizes will be awarded from among all eligible, non-suspect entries received prior to the event requiring such cancellation. False or deceptive entries or acts will render a participant ineligible and also may result in participant no longer being allowed to enter the CEA Study Abroad Photography Contest, or other promotions or contests in the future, at CEA's sole discretion. Once submitted, all entries become the exclusive property of CEA and will not be acknowledged nor will they be returned. Limit one (1) winner per person.
INDEMNITY: By submission of the Contestant's entry into the CEA Study Abroad Photography Contest, the Contestant shall indemnify and hold CEA harmless from and against any and all claims, actions, or demands, including those resulting from the defamation, liable or slander of an organization or individual, any civil liability for the failure to obtain and submit any necessary model release forms (ADULT/MINOR), or failure of the Contestant to abide by all rules, laws, and statues of both the location where a photo was taken and in the US. Furthermore, the Contestant's agrees to abide by all applicable copyright laws in regards to their Contest submission and it shall be implied through entry into the Contest that any content submitted to CEA is free of any claims of copyright infringement.
PRIZE: One (1) Contest Winner will receive One (1) $250 AMEX gift card; approximate retail value of Grand Prize: not to exceed: $250 USD. The Winner of the prize will be determined by online votes through CEA Study Abroad Photography blog between the dates of August 11, 2008 and August 22nd, 2008. All decisions shall be final in all matters pertaining to this Contest.
CEA is not responsible and will not replace any lost, stolen, misplaced or damaged Prizes. CEA is not responsible for warranty issues related to Prizes. CEA is not liable for late, lost, misdirected or unsuccessful efforts to send the Prize to Recipients. Prize Winners may be issued a Form 1099 for tax purposes in the amount of the approximate retail value of the Prize and must submit their Social Security Number, as required by law.
NOTE: Regardless of prize won, all federal, state and local taxes are the sole responsibility of the winner. Prizes are neither redeemable for cash; nor can they be transferred or substituted, except by Sponsor with one of equal or greater value. Sponsor has no responsibility for Winner's inability or failure to accept the Prize as described herein.
ODDS OF WINNING: Odds of winning a Prize depend upon the total number of all eligible entries received and the number of people who vote. Decisions shall be final in all matters pertaining to this Contest. All potential Prize Winners will be notified by phone, e-mail and/or in person on or about August 30th and may be required to submit their Social Security Number as required by law in order to issue a Form 1099 for tax purposes. Failure to submit one's social security number by the return date specified in the prize notification may result in forfeiture of the entire Prize, and the selection of an alternate potential Prize Winner.
LIABILITY & RELEASE: Sponsor & Others are not responsible for, whether directly or indirectly, any liability in connection with any injuries, damages or losses of any kind, whether to property or person, including death, arising out of the acceptance, enjoyment, use and/or misuse of any Prize and/or participation in this Contest, and they will be held harmless against any such claims of liability arising directly or indirectly from the acceptance or use/misuse of the Prize, including activities that are not sponsored or provided by Sponsor.
INTERNET: Sponsor and Others are not responsible for interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer transmissions or jumbled, scrambled or misdirected entries or transmissions, or for phone, electrical, network, computer hardware or software or program malfunctions, failures or difficulties or for other errors, omissions, interruptions, or deletions of any kind whether human, mechanical or electronic or for any damage to any person's computer related to participating in the promotion. Sponsor & Others are not responsible for illegible, unintelligible, late, lost or stolen entries or incorrect or inaccurate entry information, whether caused by Internet users or by any of the equipment or programming associated with or utilized in the promotion or by any technical or human errors which may occur in the processing of any entries in this promotion. Persons found tampering with or abusing any aspect of this promotion, as solely determined by Sponsor, will be disqualified and may be subject to prosecution. Any entrant who attempts to enter with identities, or uses any other device or artifice to enter multiple times or to interfere with the proper play of this Contest, will be disqualified from participation in the Contest. If in the judgment of Sponsor, the Contest is compromised by virus, bugs, non-authorized human intervention or other causes beyond the control of Sponsor, which corrupts the administration, security, fairness or proper play of the Contest, Sponsor reserves the right, in its sole discretion, to discontinue, suspend or terminate the Contest. In the event of any such discontinuation, suspension or termination, the winners of any remaining prizes not yet won will be determined from among all eligible entries received to date, voted on by the panel of CEA judges following the discontinuation, suspension or termination or in such fair and reasonable manner as decided by the judging panel. Any personally identifiable information collected during an entrant's participation in this promotion will be collected by Sponsor and used by Sponsor, its affiliates, agents and marketers for purposes of the proper administration and fulfillment of the Contest as described in these Official Rules and in accordance with Sponsor's Privacy Policy. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared submitted by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
GENERAL: By participating in this Contest, entrants agree to be bound by these Official Rules. By accepting a prize, the winner grants Sponsor the right to use his/her individual name, address, school attending, photograph, and likeness for advertising, publicity & promotion purposes and for any other such purposes as Sponsor so determines, in any and all media worldwide without limitation, without further compensation, notice or permission, except where prohibited by law. Sponsor is not responsible for postage-due, late, lost, counterfeited, illegible or tampered entries/mail. The interpretation of these Official Rules shall be governed by the laws of the State of Arizona. Any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, and without resort to class action, in the appropriate courts in Maricopa County, Arizona exclusively. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or a party's rights and obligations, shall be governed by, and construed in accordance with, the laws of the State of Arizona, without giving effect to any choice of law or conflict of law rules of any other jurisdiction. All federal, state and local laws and regulations apply. Void where prohibited or restricted by law.
